Privacy Policy

The protection of your privacy is important to SuperBird Capital and its subsidiaries, particularly SuperBird and G-Tech Parts (collectively "SuperBird" or "we") and that is why we are seriously concerned about the confidentiality of the personal information of our customers, our employees and the users of the Girardin Website and G-Tech Website (the « Websites ») as well as compliance with the applicable law.

The purpose of this privacy policy (hereinafter the "Policy") is to explain and describe how we collect, use and disclose your personal information, when applicable. This Policy is designed to comply with Canadian federal and provincial privacy laws.

  1. Scope of Policy

    This Policy applies to personal information that is in our possession or that is under our control, including information that is collected during the use of the Websites, but also when your personal information is collected by our branch employees. The Policy also applies to personal information that we collect about SuperBird employees or applicants for employment with SuperBird.


  2. Acceptance

    If you access our Websites, you agree to be bound by the terms and conditions contained in this Policy. If you do not agree to be bound by these terms and conditions, please do not access or use the features of our Websites.


  3. Amendments to the Policy

    We will occasionally update this Policy and we reserve the right to change the content of this Policy at any time. Any amendments made will appear on our Websites. The date of the latest version of this Policy appears at the bottom of the page. We recommend that you print a copy of this Policy for your records and review this section of our Websites periodically.


  4. Consent

    SuperBird recognizes that your consent to the collection, use and disclosure of your personal information must be clear, free and enlightened.

    Your consent must be given for specific purposes. Depending on the nature and sensitivity of the personal information, your consent may be express (such consent may be given orally, in writing or electronically) or implied (for example, when you voluntarily provide us with personal information).

    Generally, SuperBird will seek your consent at the time of collection of your personal information, such as when you register on our Websites, visit our Websites, make a purchase on our Websites or in a store, or apply for employment, unless we are required or otherwise permitted by law.

    You may withdraw your consent at any time, subject to applicable legal restrictions and reasonable notice. Please note that if you choose to withdraw your consent to the collection, use or disclosure of your personal information, some of our Websites or services may no longer be available to you.


  5. Collection of your personal information

    SuperBird only collects the personal information that is necessary for the purposes of establishing, managing and maintaining our relationship with you.

    For example, in a non-limitative way, the following personal information may be collected : your first and last name, your gender, your date of birth, your complete home address, your phone number, your email address, your banking information and your Internet Protocol address (commonly known as "IP address"). SuperBird may collect any other personal information necessary for us to provide our services to you, including through the Websites or when you interact with a SuperBird employee by email, telephone or in person.

    Non-personally identifiable information such as your purchase history, work experience, education, employment status, or communication preferences may also be collected to enable us to provide you with personalized services.


  6. Collection of personal information through third parties

    Generally, we will obtain your personal information directly from you. However, we may also collect personal information about you from external sources with your consent, or without your consent, but only if the law so authorizes.

    For example, in order to provide you with a personalized experience and access to products and services relevant to you, SuperBird may use marketing automation services to create targeted marketing campaigns across multiple platforms and thereby collect personal information about you.


  7. Use of your personal information

    The purposes for which SuperBird collects your personal information shall be identified at or before the time of collection. SuperBird may collect your personal information for the following purposes:

    • identify you as a user of our Websites and allow you to access your account;
    • to create and maintain our customer accounts;
    • to provide you with the products, services or information you have requested;
    • contact you, in accordance with public health guidelines, if you have visited one of our branches and we are informed that another individual present at the same time in one of our branches was contaminated with COVID-19;
    • establish and maintain our business relationship with you;
    • improve our range of services, including the use of the Websites or any other online or over-the-counter services;
    • to organize and administer contests or surveys;
    • communicate with you when you submit questions, comments, prayer requests or suggestions;
    • provide you with information about our services that may be of interest to you ;
    • process your job application or internship request ;
    • prevent and detect errors, theft, fraud and other illegal activities;
    • meet the requirements of the law
    • or for any other purpose for which you have provided your consent at the time of disclosure of your personal information.
    • Your personal information will not be used for purposes other than those described above, except with your consent, or as required or permitted by law.


    SuperBird uses your personal information only for the primary and applicable lawful purpose for which your information was collected.


  8. Cookies

    Your use of the Websites allows SuperBird to automatically compile certain information about your user profile, which may include the Internet Protocol address (or IP address) of your computer, your geolocation area, the operating system you are using, your language preference, the identity of your Internet Service Provider, the date and time you access this website, the previous website you visited that provided you with a link to our Websites, and the content viewed and downloaded from our site or the number of visits.

    To do this, our Websites, like most websites, use cookies, which are small data files that are stored on your computer when you visit. SuperBird uses this information to tailor the Websites to your preferences and to compile statistics about the viewing and use of the Websites in order to improve it.

    SuperBird may use third party service providers such as Google and Facebook for ad retargeting purposes. SuperBird may also use web beacons to enable our third-party tracking tools, such as Google Analytics, to collect personal information about you.     As with most Internet browsers, it is possible to erase cookies from your computer's hard drive, block the creation of cookies or receive a warning before a cookie is stored. However, doing so may affect your use of our Websites and you may not have access to all of its features.   9. Disclosure of Your Personal Information:

    A) to third parties in Quebec

    SuperBird recognizes that, except in the case and under the conditions described in this Policy or as permitted by law, the disclosure of your personal information to third parties requires your consent.

    Access to your personal information within SuperBird does not require your consent but is strictly limited to the persons for whom the information is necessary for the performance of their functions and duties.

    SuperBird may share your personal information, without your consent, with agents, service providers or consultants who need the information to conduct SuperBird's business or to help SuperBird administer its Websites. Such agents, service providers and consultants will warrant by contract that they will use the personal information provided to them only to perform specific services and will keep it confidential in accordance with this Policy.

    SuperBird may also, without your consent, disclose your personal information to third parties where permitted or required by law, for example, to prevent fraud or serious physical harm to any person. Whenever SuperBird is required to disclose your personal information, we will endeavour not to disclose more information than is required under the circumstances.

    Please note that you have the right to know, upon request, to whom your personal information is disclosed and the circumstances that led to its disclosure and you will find in the section 13 of the Policy the contact information to make such a request.

    B) outside the province where you normally reside

    SuperBird does not generally share your personal information for hosting or data processing purposes outside your country of residence. However, SuperBird may occasionally disclose information outside of the province in which you normally reside (to another province or outside of Canada) in the course of performing a service or enterprise contract, for example, for hosting or data processing. You consent to the transfer of your personal information to provinces and countries other than your place of residence, or the privacy rules may be different from those applicable in your place of residence.


  10. Safeguards

    SuperBird has implemented a series of security measures to protect your personal information against loss or theft, as well as unauthorized access, disclosure, copying, use and modification, taking into account, among other things, the sensitivity of the information and the purposes for which it is used.

    These security measures include :

    • physical measures (e.g., restricted access to offices for employees and volunteers, backup and archiving of data using an external system, etc.);
    • administrative or organizational measures (e.g. restricting access to what is strictly necessary (also called need-to-know basis), etc.);
    • technological measures (such as the use of secure passwords, use of a firewall, data encryption, use of SSL, etc.) that are reasonable in light of the sensitivity of the information, its use, amount, distribution and medium.


    SuperBird is also committed to take the necessary steps to ensure that all of its employees are informed about the contents of this Policy and educated about best practices for the protection of personal information.

    However, since no mechanism provides foolproof security, there is always some degree of risk. It is your responsibility, if you create an account on our Websites, to keep your password confidential and to change it regularly.


  11. Accuracy

    SuperBird recognizes the importance of accurate, complete and up-to-date personal information and takes reasonable steps to ensure the accuracy and completeness of the information it uses or discloses.

    However, it is your responsibility to inform SuperBird of any significant changes that may occur to your personal information and to ensure that all personal information in your account is accurate, by making the relevant changes directly in your account via our Websites or by contacting us by email as necessary


  12. Retention of Personal Information

    SuperBird retains personal information only as long as necessary for the purposes for which it was collected and to comply with our legal and regulatory obligations. If you have further questions about how long we retain your personal information, you may contact us at the contact information provided in Section 13 of this Policy.


  13. Requests for access and rectification

    Any questions or concerns about the Policy or about the collection, use or disclosure of your personal information, including requests for access or correction, should be made in writing and addressed to the following contact person

    You have the right to request access to your personal information held by SuperBird.

    We will provide you with your personal information, when collected electronically, in a structured, commonly used technological format. You may also request that your personal information be corrected if it is inaccurate, incomplete or misleading, or if its collection, disclosure or retention is not permitted by law.

    SuperBird will respond to any request for access or correction within 30 days of the date of receipt of the written request. In the event of a refusal to provide or correct information, SuperBird will provide you with the reasons for its refusal and the sections of the applicable law that support its refusal, subject to the limitations of the law, and we will inform you of your recourse.

    If SuberBird refuses to correct your personal information, we will allow you to make written representations to us regarding the personal information that has been refused correction. SuperBird will also retain the personal information that was the subject of an access request for as long as necessary to allow you to exhaust any recourse provided by law.
